  • Is the PetWill Pet Trust really a valid legal document in my state?

The PetWill Pet Trust document is designed to be valid in all 50 states and the District of Columbia in the United States of America. We cannot guarantee the interpretation of the validity and enforceability of a PetWill Pet Trust document under the laws by local, state and federal authorities and courts.

  • Do I really need a PetWill? Won't someone take care of my pet in case something happens?

We all want to believe that a friend, family member or "someone" may take care of our pets. Perhaps they even told us they might. But why leave something like your pet's life to chance? An estimated 500,000 loved pets are abandoned or killed every year because a pet owner just like you believed a family member, friend or caregiver would provide care. The law views your pets as property so they have very little to no rights. It is up to you to protect your pet's future. A PetWill allows you to document your pet's photos, care instructions, diet, needs, vet info, allergies, microchip ID, medication and more. Only you know the most important details about your pet. PetWill let's you put it in writing, backs up your wishes online 24/7 and gives your pet's their own voice when it matters most.

  • I have a will or trust for myself already. Do I still need a PetWill?

Having an estate plan for yourself is just the first step. A PetWill Pet Trust goes the extra mile and includes plans that are specific to your pet and your pet's unique needs. By getting a PetWill you have a standalone legal pet trust that recognizes your pet as the beneficiary and gives your pet legal rights. PetWill is easy (takes minutes) and affordable (only a one-time $15.95 for your first pet and $9.95 for each additional pet). You also get to name up to three pet guardians who will provide day-to-day care. This gives you peace of mind for your pet's future should anything happen. If you have a will already, the law does not allow you to leave money outright for your pet. Doing so can cause your will to be contested and judges have prevented pets from receiving money. PetWill allows you to leave money directly for your pet's care. Furthermore, most people neglect to mention their pets as part of their estate planning or their attorney may not be familiar with planning for pets. At PetWill, planning for your pets is our number one priority. Getting a PetWill can be the most important thing you get for your pet.

  • I do not have a trust or will of my own. Should I still get a PetWill for my pets?

YES, you can still get a PetWill even if you don't have an estate plan of your own. We believe every pet owner deserves to have a PetWill to protect their pets. That's why we made it simple and affordable for nearly anyone in America to safeguard any of their pets. Your PetWill Pet Trust document is a standalone pet trust that may assist your pets to be taken care of when it matters most. We encourage you to tell other pet parents about the importance of a PetWill. You may be saving their pet's life too.

  • Can laws change in the future affecting my PetWill Pet Trust document?

Usually new laws that are passed are forward thinking, meaning that previously made legal agreements remain valid. However, in the event that future laws may affect your PetWill we will have a new version for you at a discounted price to help take care of your pets.

  • Can I have my own attorney review the PetWill Pet Trust document to customize it for my situation?

You may choose to have your own qualified attorney review the PetWill Pet Trust document. Some of our customers have chosen to have their attorneys create a Trust Amendment. (Whether one should amend a trust or restate it will depend on the number of changes one is making, and other factors). However, please be aware that changes made to your PetWill Pet Trust document are not covered by our Terms of Use & Privacy Policy. If you amend your PetWill Pet Trust document you are doing so at your own risk.

  • How do I get the PetWill Pet Trust document notarized?

Many banks and brokerage offices offer notary services. Independent notaries can be found in your local directory or online. Nearly all law firms should have a notary on staff. Fedex Office and The UPS Store usually offer notary services at their locations. Most states have maximum fees notaries public can charge. The fees are typically capped at $2-$10 per page or $5-$10 per notarial act if you go to the notary at their location. If the notary comes to you they often charge a nominal travel fee. You can also look into http://www.notarize.com which is a service that may enable you to notarize your PetWill without leaving your home through your smartphone.

  • If I make changes to my existing PetWill Pet Trust, do I need to download the new document and get it notarized again?

If you are updating your Pet's Online Profile, which consists of their care instructions, allergies, photos, diet, medication, Microchip ID number, Pet License number and other information relating to their individual care, there's no need to re-notarize your PetWill. You can print the new version of the "Schedule A Property Transferred to the Trust" page which is towards the end of the PetWill Pet Trust document and have it for your records.

If you add a brand new pet to your existing PetWill, change the name of any of your Pet Guardians, change the name of any of your Trustees, change the name of your PetWill Pet Trust itself and change your State of Residence, YES we recommend downloading your updated PetWill Pet Trust document and getting it re-witnessed by two people and re-notarized so your changes will be in effect.

  • Do I need to have 2 witnesses with me when I notarize my PetWill Pet Trust document?

Not all states require two witnesses. However, we want the PetWill Pet Trust document to be valid in all 50 states and the District of Columbia. The best practice is to always have two witnesses and a third person who is a notary when you sign your PetWill Pet Trust document. All persons should be present at the time you sign your PetWill Pet Trust document.

  • Where are the Instructions and Schedule B: Trust Assets documents that came with the PetWill?

Once you have successfully logged into your PetWill account on http://www.MyPetWill.com, you may be taken to the "View / Edit Existing PetWill" section.

Look to the right side of the page and you will see a red and blue button linked to your downloadable/printable PetWill Pet Trust document. The button is called

    DOWNLOAD MY PETWILL
    One document for all pets

    PetWill

Once you download this PetWill Pet Trust document in .PDF format, you can view the document and/or print it. Towards the end of the document you will see the "PetWill Schedule B Pet Trust Assets" where you can manually type in the financial information (if any) and print it. Please remember to bring this completed "PetWill Schedule B Pet Trust Assets document" with you at the time of notarization. You do NOT have to bring the "PetWill Pet Trust Instructions" that come with the PetWill pet trust document.

  • Why do I have to manually write my signature, date and other information in the document?

Your PetWill Pet Trust document requires your signature, two witnesses and a notary to make sure it is valid. Thus it must be signed and dated by all parties in front of the notary at the time of notarization of the document. That is why you cannot "pre-date" or "pre-sign" automatically when you purchase your PetWill. Inserting the date and other information is important for identification of your PetWill Pet Trust. Be sure and fill in all spaces as indicated.

  • Why do I have to manually type in my financial information if I am leaving funds for my pet's future care?

For your privacy, PetWill does not store your sensitive financial information anywhere on our systems.

PetWill enables you to download your PetWill document once you have completed it fully. As part of your single PetWill document a section at the end called "Schedule B Pet Trust Assets" is where you manually type in financial information should you be leaving funds for your pet's future care.

  • What is a Pet Trust?

We are not providing any legal advice. For general information purposes only, a Pet Trust is a legal instrument designed to provide financial resources for the benefit of one or more pets. Pet trusts can be traditional pet trusts where there is a human beneficiary charged with the responsibility of providing care for a pet. A traditional pet trust is valid in all 50 states and the District of Columbia. Statutory pet trusts are authorized by state statue where the beneficiary of the trust is a pet, rather than a person. Generally a pet guardian, trustee and trust protector would be appointed to provide care for the pets, manage the trust assets and enforce the trust provisions. Statutory pet trusts are now valid in 50 states and the District of Columbia.

  • Do each of my pets need their own PetWill Pet Trust document?

You can certainly choose to buy a separate PetWill (at $15.95 each) for each of your pets. However, we have made it so you can add all of your current pets to 1 PetWill (first pet will be $15.95 and each additional pet added to your PetWill will be $9.95 each). It is recommended that you plan for each of your pets in your PetWill Pet Trust document. That plan may include a trust if the pet parent has the desire to ensure the pet has a lifetime guardian, a trustee to manage the trust assets and sufficient resources to provide for the pet’s lifetime needs.

  • Should I leave specific instructions for the care of my pet?

Yes. Pets are members of our family and each has individual needs and requirements. Pet care instructions are essential so future pet guardians can provide a pet with the proper nutrition, medical care, exercise and lifestyle. Each Pet's Online Profile and comprehensive pet care notebook for the care of your pet(s) is recommended.

  • Who should be the Pet Guardian and the Successor Pet Guardian?

The pet guardian should be a trusted individual to provide a level of love and care consistent with the care provided by the pet owner. It is important to have one to three alternate pet guardians in the event the first choice is unavailable or unwilling at the time care is needed. If an individual pet guardian is not available, select a willing rescue organization, perpetual care organization or veterinary school with a pet care program. Your Pet Guardian could also be financially responsible for your pet if you don't leave sufficient money for your pet's lifetime care.

  • Who should be the Trustee and the Successor Trustee?

Your Trustee and any successor Trustee is the individual or organization responsible for the day-to-day management of the trust's financial assets. Duties can include investment, distribution and administration including an annual accounting and filing any required income tax returns. The pet trust trustee should be a trusted individual or organization whom you know well. It is recommended they have the management and fund distribution experience necessary to ensure the terms of your pet trust are carried out for the benefit of your pets.

  • Who should be the Remainder Beneficiary?

Your Remainder Beneficiary is that person or individual who should receive any financial assets (money or property) left in your PetWill Pet Trust when the trust purpose has been completed; after all of your pets have been cared for during their lifetime. Some of our clients have listed their favorite accredited animal charity as Remainder Beneficiary. In this scenario this charity would receive the remaining funds in that PetWill pet Trust.

  • What is a Trust Protector and do I need one?

We are not providing any legal advice. For general information purposes only, a Trust Protector is an individual appointed in the trust instrument or by a court for the purpose of enforcing the terms of the pet trust on behalf of the pets. Trust Protectors may also be empowered with the ability to remove and replace Trustees and Pet Guardians, amend trust provisions or take other actions to ensure the intent of the Trustmaker are followed. Trust Protectors are recommended for all trusts that will become irrevocable upon their creation or upon the death of the Trustmaker.

  • How do I make sure each pet has enough money?

Making sure your pet has sufficient resources to provide for its lifetime care is essential. Determine what you spend on each pet now and then multiply that annual figure by several years per pet to be safe. Then add some funds in the event of an emergency or catastrophic illness. Creative ways to fund a pet trust include leaving retirement plan assets and life insurance proceeds. Some pet parents will want to leave their home and resources to maintain the home so pets can remain in the own environment for the balance of their lives. The most popular choice can be simply to open a trust bank account with your bank in the name of your pet trust with sufficient funds in place. Please remember some pets require more funds than others, depending on their needs, medical conditions and species.

  • When does a Pet Trust end?

We are not providing any legal advice. For general information purposes only, most state statutes require the pet trust end when the last living pet covered by the trust has died. Some statutes include pets that may be in gestation at the time the pet trust became effective. Please consult with a qualified attorney in your jurisdiction for further assistance.

  • Who gets the money left in a pet trust?

We are not providing any legal advice. For general information purposes only, the remaining pet trust assets may be distributed to the individual or organization named in the pet trust and if none, then pursuant to the relevant state pet trust statute. Typically, it would be returned to the Trustmaker, if living and if not, to the Trustmaker’s estate or to his or her heirs. Please consult with a qualified attorney in your jurisdiction for further assistance.

  • How are Pet Trusts taxed?

We are not providing any legal or tax advice. We suggest you seek the guidance of a qualified tax professional in your jurisdiction for your specific circumstances. For general information purposes only, pet trusts may essentially be taxed in three (3) ways:

    1. Taxed to the Trustmaker. During the lifetime of the Trustmaker, trust earnings are taxed to the Trustmaker as a Grantor Trust.

    2. Taxed to the Beneficiary. For a traditional pet trust where there is a human beneficiary charged with the responsibility of providing care to the pet, all trust distributions of income will be taxed at the pet guardian’s personal income tax rate. As a result, it is important to consider the possible tax ramifications for traditional pet trusts. For statutory pet trusts where the pet is the beneficiary, the IRS has determined that a pet trust is not valid for tax purposes, but notwithstanding, they reserve the right to tax the trust income at trust tax rates.

    3. Taxed at trust tax rates. Trust tax rates are the same as individual tax rates but get to the highest rate at lower levels of income. A trust earning income in excess of $12,300 in 2016 may have a tax rate of 39.6%.

  • What if I do not leave money for my pet? Will my PetWill Pet Trust document still be valid, enforceable and provide my pet with legal protection?

Your PetWill Pet Trust document can still provide valuable protection for your pets. Your Online Pet Profile and Identification Tag will still provide the critical information necessary to provide care for your pet, including the names of all Pet Guardians. If you don't leave any or enough money for your pet, your named Pet Guardian will need to assume the financial responsibility for your pets. That's why it is important to make sure the people and organizations you choose as Pet Guardians are prepared to provide lifetime care. We encourage everyone with a PetWill to make sure there are sufficient assets to provide care for your pets and that your PetWill Pet Trust document is properly funded. Money in bank accounts can be left for the care of your pets often known as "Trust Bank Accounts" and directly linked to your PetWill Pet Trust document which the bank might require a copy. You can also leave retirement plans, insurance policies, stocks and more for your pets' care. Once you download your PetWill Pet Trust document a section towards the end called "Schedule B Pet Trust Assets" is where you manually type in financial information should you be leaving funds for your pets' future care, then print the PetWill Pet Trust document with this information completed. For your privacy, PetWill does not store your sensitive financial information anywhere on our systems as all of this information is on your local computer.

  • Do I have to update my State of Residence in my PetWill if I move to another state? And if so, does it affect my PetWill Pet Trust document, requiring me to re-print and re-notarize my PetWill Pet Trust document?

We have designed the PetWill Pet Trust document to be valid in all 50 states. However, if you move to a new state, YES, we encourage you to update your State of Residence in your My Account page, re-print your PetWill Pet Trust document, have two witnesses present and re-notarize it in your new state. Furthermore, you may choose to consult with a qualified attorney in your new home state to make sure all estate planning is consistent with your new state's laws. Because each state has a different interpretation of pet trust laws.

We purposely do not offer QR codes on our tags. A survey by INC magazine found out that 97% of people do NOT understand QR Codes or know what they are! On top of that, most consumers are unsure which app to use to read a QR Code, or how to search for an app to read one. Also QR codes may fade or become unreadable on Pet ID Tags if they get scratched or fade over time.

PetWill's ID Tags are made of high quality stainless steel and built to endure the elements. Your PetWill Pet ID Tag has your pet's unique Online Profile link laser-engraved on it. • DONATIONS

  • Does PetWill make donations to animal shelters and/or animal rescue groups?

Yes we happily donate to local and national animal shelters and animal rescue groups from our own earnings. Our criteria is that such organizations must be accredited, in good standing and be a 501(c)(3) IRS approved non-profit. We also partner with leading animal shelter and pet rescue organizations in local areas in the United States to share 15% of revenues from each PetWill they sell through our affiliate program.

  • How can I find out who your animal shelter and pet rescue organization partners are in my local area?

We are working on a full page which lists the exact names of our animal shelter and pet rescue organization partners. Please stay tuned for updates. If you know of a non-profit rescue organization whom you believe would benefit from getting to know PetWill, you can decide to contact them and tell them about PetWill. We are always looking for more non-profit partners.

  • BILLING

  • What forms of payment do you accept?

We accept Visa, MasterCard and PayPal. We do not accept checks, cash or any other form of payment.

  • What is your pricing for your products?

The $15.95 lifetime registration fee for a PetWill covers 1 pet.

    It includes an:

Online Pet Profile Website for your Pet

1 Pet ID Tag shipped to you for free. If you own more than 1 pet and wish to add them to your PetWill you can add each additional Pet for $9.95 each.

You order duplicate Pet ID Tags for $9.95 each.

  • Do you offer full or partial refunds?

We do not offer refunds. We ask you to consider how we operate to keep prices as low as possible to allow every pet owner in America to protect their pets. Once you pay for your order, we produce a custom PetWill document based on the information you typed. We also produce a custom-engraved Pet ID Tag for each of your pets that you added on the PetWill. It costs us significant money per order to produce these custom Pet ID Tags for the safety and identification of your pets. Additionally, our system creates a custom Online Pet Profile website for each of your pets. Once your order is placed and paid, we cannot refund any moneys due to all of these reasons. This is also written in the terms of use our users agree to before they place orders. We appreciate your cooperation in understanding this policy.

  • My payment was declined. What should I do?

When a payment is declined, for reasons of privacy, credit card companies don't give the vendors (in this case, PetWill) a reason for why a payment is declined.

There are usually two common reasons which solve most of these declined errors

    1. One is insufficient funds on the card.

    2. The second is that the card company flagged the payment as suspicious or potentially fraudulent.

Please contact the card company and ask them to authorize the transaction and then you can try again. For your security and privacy, we do not have any way to contact the credit card company on your behalf.

  • What are other payment errors?

For any other billing errors, you will most likely need to contact your bank and inquire about why the card is not being accepted. When speaking with your bank, please provide them with details for the dates and amounts of the transactions that are not going through.

Possible reasons for a card being declined include:
    1. Amount is over the card's limit or available funds at that time.

    2. A hold on the account.

    3. The bank does not accept transactions from certain websites or online merchants.

    4. The bank will not allow an international transaction without specific approval for the merchant.

PetWill is based in the United States.
